The court ruled that the directors had exploited their position to appropriate the money that had been deposited into the company's account after the sale of the property. The property had been purchased by Gerhard Wolfgang Arnold Ewert before his death, but the transfer of ownership had not been completed. After his death, the heirs authorized the company to sell the property and pay them the proceeds. The company sold the property and received €50,000, but failed to pay the agreed amount to the heirs. Instead, the money was withdrawn in cash from the company's account and used for personal gain. The court described the case as particularly serious and emphasized the lack of genuine remorse from the convicted individuals.
