Appeal Court Upholds Decision Against Arrest Warrant for Tax Evasion Suspect
The Court of Appeal rejected the Attorney General's appeal and upheld the decision of the Limassol District Court, which dismissed a request for the execution of a European Arrest Warrant (EAW) against an individual wanted by German authorities for serious tax evasion offenses. The EAW was issued in August 2025 and concerns charges of tax evasion amounting to €1,796,689.12 and involvement in a fraud scheme that caused damage of €12,736,196.74 to the German public treasury. The Court of Appeal ruled that there was significant uncertainty regarding the suspect's legal representation in Germany, making it difficult to exercise their rights. This lack of representation substantially affected the practical value of the right under Article 10 of Directive 2013/48/EU.
