The case concerned three teachers with disabilities who could not be permanently appointed due to the program's non-operation. The Court emphasized that the Administration had a legal obligation to ensure 10% of appointments were for people with disabilities and to take necessary measures, such as operating the program, regardless of financial difficulties or other considerations. This omission deprived the teachers of timely participation in the program, potentially causing losses in their professional development. The Court ruled that the appeal was admissible even after their appointment, as the omission was ongoing. Those affected can now seek compensation for the damages they have suffered.
