Supreme Court Rejects Tychikos' Appeal Regarding Dismissal from Paphos Metropolitan Position

The Supreme Court of Cyprus has rejected the application of former Metropolitan of Paphos, Tychikos, for an extension of the deadline to file an application to annul the decisions of the Holy Synod of the Church of Cyprus and the Ecumenical Patriarchate that dismissed him from his position. Tychikos had appealed to the Ecumenical Patriarchate after the decision of the Holy Synod of Cyprus, which was later ratified by the Patriarchate. The application by Tychikos was based on the delay in filing the application for leave to issue prerogative orders (Certiorari, Mandamus, and Prohibition). The Court ruled that the delay was not justified, as the applicant had knowledge of the decisions from the date of their issuance and did not file the application within the prescribed 45-day deadline. According to the decision, to justify an extension of the deadline, there should be 'exceptional circumstances' – a specific reason that prevented the applicant from appealing to the Court within the prescribed timeframe. The Court found that such circumstances did not exist in this case. The Supreme Court's decision effectively confirms the dismissal of Tychikos from his position as Metropolitan of Paphos, as he is not given the opportunity to challenge the decisions of the Holy Synod and the Ecumenical Patriarchate through the process of prerogative orders.
