Young Man Denied Job Opportunities Due to Criminal Record – Court Rejects Restoration Request

A young man in Cyprus is facing a serious problem as he is unable to find employment due to his criminal record. Despite his sentence being minor and initially assessed as eligible for restoration, his criminal record remains unblemished, preventing him from working in positions that require a clean record. The Court rejected his request for a restoration order, citing lack of jurisdiction and the absolute nature of the relevant law. The young man was sentenced to 5 months imprisonment suspended for possession and distribution of child pornography. He was under 20 years old and admitted to possessing a limited file of child pornography. Because his sentence was not high, it should have been restored after three years, but it did not happen. This situation prevents him from working, having applied for a position at the Limassol Municipality, where a clean criminal record is required. His lawyer argued that the absolute exclusion of criminal record restoration is contrary to the Constitution and fundamental rights, as it violates the right to privacy and work. However, the representative of the Attorney General stressed that restoration is a policy choice of the legislature and does not constitute an individual right. The Court ruled that, according to existing legislation, restoration is only possible for sentences between 2 and 4 years, after 8 years, while in this particular case these conditions have not been met.
